Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the websites, web applications, and mobile applications operated by Circle Sure Technologies (Pty) Ltd, including the ERUS Consumer App and ERUS Work App(collectively, the “Services”). By creating an account or using any of the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services. By using the Services, you represent and warrant that you meet this requirement.

2. Accounts

  • You are responsible for your login credentials and all activity under your account.
  • Provide accurate, complete, and current information and keep it updated.
  • We may suspend or terminate accounts for fraud, misuse, or breach of these Terms.

3. Service Overview

ERUS connects consumers (“Clients”) with independent service providers (“Professionals”). Circle Sure Technologies is a technology platform—not an employer, agent, or contractor of Professionals. We do not control or guarantee the quality, safety, or legality of services provided by Professionals.

4. Bookings, Changes & Cancellations

  • Service details, pricing, and availability are shown before you confirm a booking.
  • Clients and Professionals are responsible for honoring confirmed bookings. Any change or cancellation policies will be displayed in-app or during checkout.
  • We may assist with dispute facilitation but do not guarantee outcomes between users.

5. Payments & Fees

  • Payments are processed by third-party payment providers. By confirming a booking, you authorize charges for the displayed amount and any applicable fees/taxes.
  • Platform service fees or commissions may apply and will be disclosed to Professionals.
  • Refunds or adjustments (if any) are handled in accordance with our Refunds Policy.

6. Professional Obligations

  • Professionals act as independent contractors and are solely responsible for compliance with all applicable laws, licenses, insurance, and tax obligations.
  • Professionals must deliver services with reasonable care, skill, and diligence.

7. Client Responsibilities

  • Provide accurate service requirements, access, and safety information.
  • Do not request unlawful or hazardous services.
  • Treat Professionals, other users, and staff with respect and fairness.

8. Prohibited Conduct

  • Fraud, misrepresentation, or impersonation.
  • Reverse engineering, scraping, or unauthorized access to the Services.
  • Harassment, hate speech, abuse, or unlawful content.
  • Interfering with the platform’s security or normal operation.

9. Ratings & Reviews

Clients may rate and review Professionals. Reviews must be factual, relevant, and free of abuse or confidential data. We may moderate or remove content that violates these Terms or applicable law. Ratings may affect visibility in ERUS.

10. Communications

By using the Services, you consent to receive necessary communications (e.g., booking updates, security notices) via email, SMS, push notifications, or in-app chat. You may opt out of marketing communications at any time.

11. Third-Party Services

The Services may integrate third-party tools (payments, maps, messaging, analytics). Your use of those tools may be subject to their own terms and policies. We are not responsible for third-party services.

12. Intellectual Property

The Services (including software, text, design, trademarks, and logos) are owned by Circle Sure Technologies or its licensors and are protected by law. You may not copy, modify, or distribute any part of the Services without prior written consent.

13. Privacy

Our collection and use of personal data are described in our Privacy Policy. By using the Services, you consent to those practices.

14. Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind. We do not warrant that the Services will be uninterrupted, secure, or error-free, or that the services performed by Professionals will meet your expectations.

15. Limitation of Liability

To the maximum extent permitted by law, Circle Sure Technologies will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Services.

16. Indemnification

You agree to indemnify and hold harmless Circle Sure Technologies, its affiliates, and their directors, officers, employees, and agents from any claim, demand, loss, damage, or expense (including legal fees) arising out of your use of the Services, violation of these Terms, or infringement of any rights of a third party.

17. Suspension & Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for breach of these Terms, suspected fraud or unlawful activity, or misuse of the platform. Upon termination, your right to use the Services ceases immediately.

18. Changes to the Services or Terms

We may modify the Services or these Terms from time to time. The latest version will be posted on this page and, where appropriate, notified in-app or by email. Your continued use after changes constitutes acceptance of the updated Terms.

19. Governing Law & Jurisdiction

These Terms are governed by the laws of the Republic of South Africa. You consent to the exclusive jurisdiction of the South African courts for any dispute arising out of or relating to these Terms or the Services.
